What is Intellectual Property?

The World Intellectual Property Organization (WIPO) defines Intellectual Property as the sum of rights relating to literary, artistic and scientific works, to the performances of performing artists and to broadcasting, to inventions in all fields of human activity, to industrial designs and models, to industrial, commercial and service marks, as well as to trade names and commercial designations, to protection against unfair competition and all other rights inherent in intellectual activity in the industrial, scientific, literary and artistic fields.

The legal protection of these creations of the human mind guarantees their creator recognition and/or financial benefit for the invented or created product.

CORRÊA ROCHA offers highly specialized legal advice in all branches of intellectual property, acting in the protection, management and defense of intangible assets, always focusing on legal security and maximizing value for our clients.

CORRÊA ROCHA operates in both voluntary and contentious jurisdictions, aiming to prevent unfair competitors from illegally expanding their market share, creating confusion or association between their products and services and those of our clients.

The protection of intellectual property goes beyond safeguarding intellectual assets, fitting into a broader context of ensuring that companies can operate in a competitive market, free from illicit or unfair practices.

For this reason, certain competitive practices, even if they do not constitute a direct violation of intellectual property rights, may be subject to legal disputes. Similarly, certain intangible assets, even without formal registration, may receive legal protection.

In Brazil, advertising and publicity are regulated by the National Council for Advertising Self-Regulation (CONAR), as well as by industrial property and copyright laws.

CORRÊA ROCHA offers consulting services on the legal and ethical standards established by CONAR, in addition to guiding clients on legal issues related to raffles, contests, loyalty programs, discounts, coupons, and gift certificates.

Our activities in this sector also include an in-depth analysis of consumer rights, which is fundamental for evaluating advertising campaigns, issuing opinions, preparing defenses or ethical representations to CONAR (Brazilian Advertising Self-Regulation Council).

Industrial design registration is a strategic asset for various sectors, such as packaging, furniture, clothing, footwear, and others.

With registration, the holder acquires exclusive rights over the external ornamental form of an object or the set of lines and colors applied to a product, provided it is new and suitable for industrial production. They can then negotiate its sale, licensing, or assignment, as well as receive the corresponding royalties for the use of their creation.

CORRÊA ROCHA has a team specialized in protecting industrial designs and drafting licensing and assignment agreements, ensuring legal and strategic security for clients.

Innovation, in its broadest sense, refers to a transformation or change. When applied to technological products, processes, marketing, organizational models, or social transformations, the concept acquires new dimensions and relevance.

Currently, technological innovation is closely linked to the social acceptance of technology, and its effective transfer depends on the use of intellectual property instruments – such as patents, industrial design registrations, software, and plant variety protection – that guarantee security and prevent misappropriation.

CORRÊA ROCHA offers specialized consulting services in technology transfer for entrepreneurs, researchers, and Technological Innovation Centers in various science and technology institutions across the country, ensuring, through specific contracts and intellectual property protection instruments, the security of all those involved in the innovation process.

Many products and services are distinguished not only by their brand, but also by the indication of their geographical origin.

These goods possess unique characteristics derived from natural resources, such as soil, vegetation, and climate, as well as local knowledge (know-how or savoir-faire). Geographical indication confers reputation, added value, and a distinct identity to products or services, setting them apart from other similar items available on the market.

CORRÊA ROCHA provides comprehensive advice regarding the protection of geographic indicators in Brazil, always in accordance with the TRIPS agreement (Agreement on Trade-Related Aspects of Intellectual Property Rights).

Trade secrets refer to any information, technical or otherwise, that is not publicly accessible and provides a competitive advantage to whoever possesses it in the market.

Unlike patents, trade secrets do not have a defined expiration date [nor a formal right of exclusivity], allowing their holder to maintain exclusivity over a product or aspect thereof for as long as they wish, provided they can keep it confidential.

Given the importance of protecting this strategic information, CORRÊA ROCHA offers consulting services to startups and multinational companies in drafting confidentiality agreements, reviewing information access procedures, developing and updating Information Security Policies, and acting in litigation processes to ensure the preservation of its clients\’ trade secrets.

Beyond the talent of the professionals responsible for creating great shows, films, or sporting events, solid legal counsel is essential to guarantee the expectation of future revenue.

In the sports field, special attention should also be paid to the promotion of social actions; doping issues, naming rights, negotiation of athletes\’ rights, merchandising, and sponsorship are all surrounded by complex legislation that, due to its specificities, requires specialized legal counsel.

In this context, CORRÊA ROCHA works to minimize risks and maximize financial returns through the negotiation, drafting, and review of various types of contracts related to productions, co-productions, distribution, and licensing of image rights, intellectual works, and industrial property rights.

Registering a computer program ensures the author is recognized and the integrity of the code is protected.

In certain situations, this registration is essential for the developer to receive adequate compensation for the effort dedicated to creating the software.

CORRÊA ROCHA offers specialized consulting services for obtaining software registrations, handling all administrative aspects with the National Institute of Industrial Property (INPI), as well as acting in legal disputes to protect the interests of its clients.

The term cultivars refers to varieties of any plant genus or species developed through selection or other breeding methods.

The protection granted to new cultivars guarantees exclusivity in the commercialization of propagation material, such as plants and seeds, for a period of 15 to 18 years, depending on the species. It is important to note that this protection does not extend to food products derived from the protected plants.

CORRÊA ROCHA offers consulting services for obtaining plant variety protection certificates, assisting with the entire administrative process with the National Plant Variety Protection Service (SNPC).

A good relationship between franchisor and franchisee is essential for the success of any franchise business.

CORRÊA ROCHA offers complete support in all stages of the business, with the aim of preventing or minimizing conflicts between the parties and ensuring the consolidation of the venture\’s success in the market.

Our activities include drafting and analyzing documents in accordance with the Franchise Law (Law No. 13.966/2019); due diligence, guidance and preparation of the Franchise Offering Circular (COF); development of confidentiality agreements and business plans; advice on contracts related to the implementation and operation of the franchise; and defense of the franchisor or franchisee in cases of contract termination.
